What Is My Case Worth?
Any lawyer who quotes you a number in the first phone call is guessing — or selling. Here's what actually determines value.
The Six Factors That Drive Case Value
Liability — Who Was at Fault, and Can You Prove It?
A clear rear-end collision with a police report and a citation is worth more than the same injuries with disputed fault. Evidence we develop early — reports, witnesses, camera footage, vehicle damage — either strengthens or rescues this factor. Partial fault reduces value proportionally in California; it doesn't eliminate the claim.
Injuries — Documented, Objective, and Explained
Insurers pay for what's documented, not what's true. An MRI showing disc protrusions outweighs months of "patient reports pain" chart notes. Surgery, injections, and specialist findings carry weight; gaps in treatment and missed appointments cut against you. This is why we don't rush settlement before the medical picture is complete.
Treatment Course & Future Care
Past medical bills are the floor, not the ceiling. A surgical recommendation you haven't acted on yet, future injections, or permanent limitations belong in the demand — once. After you settle, there is no second claim.
Lost Income & Earning Capacity
Missed paychecks are straightforward. Harder — and often bigger — is diminished earning capacity: the self-employed contractor who can no longer do physical work at full speed, documented through tax records, expert analysis, and California's jury instructions on earning capacity.
Available Insurance — the Practical Ceiling
A million-dollar injury with a $15,000 policy is, practically, a $15,000 third-party case — unless more coverage exists. This is why we research umbrella policies, excess layers, commercial coverage, and your own UM/UIM coverage in every case. Finding coverage is often the single biggest value lever.
Liens — the Difference Between Gross and Net
Health plans, Medicare, and Medi-Cal can claim repayment from your settlement. Two identical settlements can put very different amounts in two clients' pockets depending on how the liens are negotiated. We measure success by your net recovery.
What About "Pain and Suffering"?
California allows recovery for physical pain, emotional distress, anxiety, sleep loss, and the lost enjoyment of daily life — often the largest component of a serious claim. There is no fixed formula, whatever online "settlement calculators" suggest. Insurers evaluate these damages based on the credibility of the medical record, the consistency of your story, and — bluntly — the reputation of the firm presenting them. Comparable jury verdicts, which we research and cite in demands, anchor the conversation.
Why We Won't Quote You a Number on Day One
Early in a case, the honest answer is a framework, not a figure: what's strong, what's uncertain, and what we'd do to develop value. As treatment progresses and coverage is confirmed, the range narrows — and before any settlement decision, you'll have our candid assessment and a clear breakdown of what you would actually take home. The decision to settle is always yours.
