Medical Bills, Liens & Insurance Claims

The most common question we hear isn't about lawsuits. It's "who pays for my treatment?" Here's how it actually works.

Medical Bills

Who Pays for Medical Treatment?

The at-fault driver's insurer generally pays at the end of the case — not as bills arrive. In the meantime, treatment is usually paid through your own health insurance, MedPay coverage, or providers who treat on a lien.

This surprises almost everyone. The other driver caused the crash, but their insurer won't pay your doctor month to month — it pays once, at settlement, for everything. Managing the in-between period is a large part of what we do for clients: getting treatment covered, addressing billing errors, and keeping accounts out of collections while the claim is documented properly.

Health Insurance Liens & Subrogation

If your health plan pays for accident-related treatment, it usually has reimbursement rights from your settlement — you may hear from recovery contractors working on the plan's behalf. Medicare and Medi-Cal have their own lien processes with strict rules. These liens are real, but they are also negotiable, and the difference goes directly into your pocket.

Lien Work Is Where Quiet Money Is Won

In our practice, lien negotiation routinely reduces health plan claims substantially — and in one matter, we pursued a federal waiver process through multiple rounds until Medicare waived a five-figure lien entirely. The settlement number matters; the number you take home matters more.

Medical Payments (MedPay) Coverage

MedPay is optional no-fault coverage on your own auto policy that pays medical bills regardless of fault — often $5,000 or more. It can bridge gaps health insurance doesn't cover. Whether MedPay applies in unusual situations (for example, when you're hit as a bicyclist) is a policy-language question we review carefully, and whether your carrier can claim reimbursement of MedPay from your settlement is negotiable — we have obtained full waivers.

How Lien Negotiation Raises Your Net Recovery

  • We audit lien claims line by line and remove charges unrelated to the accident
  • We apply California's legal limits on lien recovery, which many claimants never invoke
  • We negotiate provider balances and litigation-funding claims at the end of the case
  • We show you a complete written breakdown — settlement, fees, costs, and every lien — before any funds are disbursed

What If I Don't Have Health Insurance?

You can still get treated. We regularly help clients find quality providers who treat accident patients on a lien basis — meaning they're paid from the settlement rather than upfront. We've represented clients with no U.S. health coverage at all and still secured both the treatment they needed and a full policy-limits recovery.
